These Terms apply to the digital and in-store services offered by Gratitude Hair Gallery.
PLEASE READ THESE TERMS CAREFULLY
These Terms & Conditions (the "Terms") govern your use of the Gratitude Hair Gallery website, mobile app, online booking tools, client account features, memberships, packages, gift cards, promotions, communications, and related digital or in-store services (collectively, the "Services").
By selecting an agreement checkbox, creating or using a client account, booking an appointment, purchasing a service or product, or otherwise using the Services after these Terms are made available to you, you agree to be bound by these Terms. Any service-specific, membership-specific, package-specific, promotion-specific, or booking-specific terms shown at the time of purchase or booking also form part of your agreement with us.
These Terms do not limit rights that you may have under applicable consumer protection, privacy, or other laws.
01 About Gratitude Hair Gallery
GRATITUDE, Gratitude Hair Gallery provides barbering, grooming, hair care, beard care, retail products, memberships, packages, promotions, and related services. We are located at 3249 Dufferin St., Toronto, Ontario M6A 2T2.
02 Use of the Website, App and Online Services
Our website, app, and online services may allow you to create and manage a client profile, book, cancel, or reschedule appointments, view services and promotions, purchase memberships, packages, or gift cards, receive reminders or offers, and access account information where available.
You may use the Services only for lawful, personal, and non-commercial purposes. You must not interfere with the functionality or security of the Services, attempt to access another person's account, use automated tools to misuse the Services, or provide false or misleading information.
03 Client Accounts
Certain features may require you to provide personal information, including your name, phone number, email address, appointment history, service preferences, membership or package information, and payment details. You are responsible for keeping account information accurate and for protecting access to your account. Please contact us promptly if you believe your account has been accessed without permission.
04 Booking Appointments
Appointments may be booked through the website, app, booking link, by phone, or in person and are subject to availability. Appointment times, service providers, service durations, and prices may vary. Where reasonably necessary due to staffing, scheduling conflicts, technical issues, or business needs, we may contact you to adjust an appointment time, reassign a service provider, modify a booking, or arrange another suitable option.
05 Cancellations, Rescheduling and No-Shows
Clients are asked to provide at least 12 hours' notice when cancelling or rescheduling an appointment. Appointments cancelled with less than 12 hours' notice, or missed without notice, may be subject to a late cancellation or no-show fee.
Before an appointment is confirmed, any applicable deposit, prepayment requirement, cancellation fee, no-show fee, or card-on-file requirement will be displayed in the booking flow, booking confirmation, or otherwise communicated to you. Repeated late cancellations, no-shows, or missed appointments may result in limits on future bookings or a prepayment requirement.
06 Late Arrivals
Please arrive on time for your appointment. If you arrive late, we may need to shorten or modify the service, assign another available provider, or reschedule the appointment. If we cannot complete a service because of a late arrival, an applicable disclosed late cancellation or no-show fee may still apply.
07 Pricing and Payments
Current prices for services, memberships, packages, products, gift cards, and promotions are shown in the booking platform, app, website, or in-store. Prices may change prospectively. Taxes, tips, add-ons, upgrades, deposits, and other disclosed charges may be added where applicable.
You agree to provide accurate and valid payment information and authorize Gratitude Hair Gallery or its payment processor to charge your selected payment method for approved purchases, deposits, disclosed cancellation or no-show fees, and other applicable charges.
08 Refunds, Credits and Service Adjustments
Completed personal services, missed appointments, late cancellations, memberships, packages, gift cards, and promotional purchases are not automatically refundable. Where appropriate, we may offer a service adjustment, store credit, account credit, or another reasonable solution at our discretion. This section does not limit any refund, cancellation, exchange, or other right that you may have under applicable law.
Please raise a concern about a service as soon as reasonably practical so that we can review it and attempt to resolve it fairly.
09 Memberships
Memberships may include selected services, credits, discounts, or other benefits. The specific benefits, service limits, billing schedule, renewal terms, cancellation instructions, eligibility rules, expiry conditions, and any other material terms shown at the time of purchase apply to the membership purchased.
Unless required by law or expressly stated in writing, unused membership benefits are not refundable, transferable, or redeemable for cash. Where a membership includes recurring billing, the recurring price, frequency, and cancellation process will be clearly provided before purchase.
10 Packages and Series
Packages or series may include a set number of services that may be redeemed during a stated validity period. They are valid only for the services described at the time of purchase and may be subject to booking availability, provider availability, expiry dates, and other stated usage rules. Packages are not redeemable for cash and may not be transferred unless we approve the transfer in writing or applicable law requires otherwise.
11 Gift Cards
Gift cards may be purchased through the app, website, booking platform, or in-store where available. Gift cards are not redeemable for cash except where required by applicable law. To the extent permitted by law, Gratitude Hair Gallery is not responsible for a lost, stolen, misplaced, or unauthorized-use gift card after it has been issued or delivered.
12 Promotions, Discounts and Offers
Promotions, discounts, promotional codes, and special offers may be subject to stated limits, expiry dates, service or provider restrictions, booking windows, eligibility requirements, and other terms. Promotions cannot be combined with other offers unless we expressly state otherwise. We may correct, cancel, refuse, or modify a promotion when there is a pricing error, technical issue, suspected misuse, or other reasonable business reason, subject to applicable law.
13 Loyalty and Rewards
Loyalty points, rewards, referrals, and account credits, if offered, may be subject to earning rules, redemption rules, expiry dates, limits, and restrictions published at the time of the offer. Loyalty points and rewards have no cash value and cannot be exchanged for cash unless required by law. We may update or discontinue a loyalty or rewards program prospectively, subject to applicable law and any stated program rules.
14 Service Results and Client Responsibilities
We aim to provide professional grooming services with care, skill, and attention. Results may vary based on hair type, hair condition, prior treatments, product use, client preferences, and other factors. Before a service begins, clients are responsible for communicating desired service details and any known allergies, sensitivities, skin conditions, scalp concerns, or product concerns that may affect the service.
15 Health, Safety and Conduct
Clients must follow reasonable health, hygiene, safety, and shop policies. To protect clients and staff, we may refuse, pause, modify, or reschedule a service where there is a safety, hygiene, health, or conduct concern. We may also refuse service or ask a person to leave the premises if they engage in abusive, threatening, discriminatory, unsafe, illegal, or seriously disruptive behaviour.
16 Transactional and Marketing Communications
We may send essential transactional or service-related messages, including booking confirmations, appointment reminders, payment notices, account notices, service updates, and responses to your requests, as permitted by law.
Marketing communications, including promotional emails, promotional SMS messages, and marketing app notifications, are optional. Where consent is required, we will obtain it separately and you may withdraw your consent for future marketing messages at any time by using the unsubscribe link, following the opt-out instructions in the message, replying STOP to an eligible SMS message, or contacting us. Choosing not to receive marketing messages will not prevent you from receiving necessary transactional or service-related communications.
17 Photos, Videos and Social Media
We may create photo or video content in our premises. We will not use an identifiable client's photo, video, likeness, or testimonial for marketing, advertising, social media, or promotional purposes unless the client has separately provided express consent through a consent form, digital consent record, or another clear documented method. Promotional photo or video consent is voluntary and is not a condition of receiving services.
A client may withdraw consent for future promotional use by contacting us. We will make reasonable efforts to stop future use and remove unused content, subject to technical, legal, and practical limitations.
18 Intellectual Property
All website, app, booking page, marketing, brand, logo, graphic, text, photo, video, service description, and design content is owned by or licensed to Gratitude Hair Gallery. You may not copy, reproduce, modify, distribute, sell, or use that content for commercial purposes without our prior written permission.
19 Third-Party Platforms and Payment Providers
Our website, app, booking platform, payment processing, email, SMS, analytics, and related services may be supported by third-party providers. Your use of those third-party services may also be subject to their own terms, privacy policies, and payment-processing rules. We are not responsible for interruptions, errors, outages, delays, or other issues caused by third-party platforms outside our reasonable control. This does not limit our obligations regarding personal information under applicable law.
20 Availability and Technical Issues
We aim to keep the Services available and functioning properly, but uninterrupted or error-free access is not guaranteed. The app, website, or booking system may be unavailable due to maintenance, updates, internet issues, technical issues, third-party interruptions, or circumstances outside our reasonable control. We are not responsible for losses, missed bookings, delays, or inconvenience caused by such issues to the extent permitted by law.
21 Limitation of Liability
To the maximum extent permitted by law, Gratitude Hair Gallery, its owners, staff, contractors, affiliates, and service providers are not liable for indirect, incidental, special, punitive, or consequential losses arising from your use of the Services. Nothing in these Terms excludes, restricts, or limits rights, remedies, warranties, or liabilities that cannot lawfully be excluded, restricted, or limited.
22 Privacy
Your privacy is important to us. Our collection, use, storage, and sharing of personal information is described in our Privacy Policy. The Privacy Policy will be available through a clearly labelled Privacy Policy link on our website and in the relevant app, booking, account-creation, and purchase flows. By using the Services, you acknowledge that you have had access to the Privacy Policy.
23 Changes to These Terms
We may update these Terms from time to time. The current version will be posted on our website and may also be made available in the app or booking platform. Updated Terms will show a revised "Last Updated" date. Where a change is material or where additional notice is required by law, we will provide reasonable notice through the website, app, email, or another appropriate method. Continued use of the Services after the effective date of updated Terms means you accept the updated Terms, to the extent permitted by law.
24 Governing Law
These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada. Any dispute will be handled in Ontario, unless another forum or law is required by applicable law.
